What is an Uncontested Divorce?
A divorce is uncontested when both spouses reach an agreement with respect to all financial and divorce-related issues (e.g. spousal support, child custody, child support, visitation, value and distribution of marital assets and allocation of marital debt). Both spouses must agree to the divorce.
Clients often believe that their divorce will be uncontested, but later learn that the other spouse does not consent to a resolution of all of the issues. Many divorcing couples try to reduce the cost of divorce by using the services of non-attorneys, such as those found on the internet. These couples often find that they must do most of the work themselves. After spending money, and a great deal of time, one party may then seek the services of an experienced attorney for their uncontested divorce.

His total fee for preparing and filing your uncontested divorce papers is $1125 (with no property and no children).** There is no better way to save precious dollars, and receive quality legal services at the same time.
The entire uncontested divorce process usually takes from 2 to 6 months, depending upon the court's caseload. Once Mr. O'Donnell has been retained, he will begin preparing the necessary papers. After the ucontested divorce papers have been completed, Mr. O'Donnell will file them with the court. At this point it is simply a matter of waiting for a judge to sign the Judgment of Divorce.
What is a No-Fault Divorce?
New York State now has a “no-fault” divorce option which allows spouses to terminate their marriages after stating under oath that their marriage has broken down "irretrievably" for a period of six months.
Although the law enables couples to divorce without having to prove specific grounds, a no-fault divorce cannot be finalized until all ancillary issues have been resolved. These issues include child custody, child support, spousal support, responsibility for payment of counsel fees and equitable distribution of marital property. For this reason a no-fault divorce may be either contested or uncontested.

*Court Filing Fees and Other Information About Fees
Divorce actions must be brought in New York State Supreme Court. The court requires payment of between $335 and $370 in fees, depending upon the county where the uncontested divorce action is filed. These court costs are included in Mr. O'Donnell's fee, so the total cost of your uncontested divorce will be $1125 (with no property and no children).**
**If you have children under the age of 21 years, and you do not have property to distribute, the total fee will be $1275.
In the event that you have property to distribute, please schedule your free initial consultation with Mr. O'Donnell so that he may provide you with an estimate of the total fee. In most cases, the total fee will not be significantly higher than the uncontested divorce fees indicated above.
